This Privacy Notice has been prepared by Point HOTEL Management A.Ş. (hereinafter referred to as the “HOTEL”), which holds the title of Data Controller, in order to fulfill the obligation to inform pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data (“KVKK”) and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform, published in the Official Gazette dated 10.03.2018 and numbered 30356.

2) SCOPE OF THE PRIVACY NOTICE

This notice covers guests, employees, and third parties whose personal data are processed through security cameras used within the HOTEL premises.

3) PURPOSES OF PROCESSING PERSONAL DATA

Your personal data are processed for the purposes of ensuring physical premises security, protecting the life and property safety of guests, employees, and third parties, and obtaining evidence suitable for use in potential disputes.

4) PARTIES TO WHOM PERSONAL DATA MAY BE TRANSFERRED

Your personal data may be transferred to Judicial Authorities and Law Enforcement Authorities for the resolution of legal disputes or as required by applicable legislation.

5) METHOD AND LEGAL GROUNDS FOR COLLECTING PERSONAL DATA

Your personal data are processed automatically through a total of 80 closed-circuit television (CCTV) cameras located at the HOTEL’s entrance and exit points, building exterior, cafeteria, guest waiting areas, and floor corridors.
The security cameras record video footage only and do not record audio.

Your personal data are processed based on the legal ground stipulated under Article 5/2(f) of the KVKK, which states that “processing of personal data is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.”

6) RETENTION PERIOD OF PERSONAL DATA

In accordance with the HOTEL’s Personal Data Retention and Destruction Policy, CCTV recordings are retained for a period of 3 months and are deleted, destroyed, or anonymized during the first periodic destruction process following the end of the retention period.

7) RIGHTS OF THE DATA SUBJECT

Pursuant to Article 11 of the KVKK, data subjects whose personal data are processed have the right to:

a) Learn whether personal data are processed,
b) Request information if personal data have been processed,
c) Learn the purpose of processing and whether personal data are used in accordance with this purpose,
ç) Know the third parties to whom personal data are transferred domestically or abroad,
d) Request correction of incomplete or inaccurate personal data,
e) Request deletion or destruction of personal data within the framework of the conditions set forth in Article 7,
f) Request notification of the transactions carried out pursuant to paragraphs (d) and (e) to third parties to whom personal data have been transferred,
g) Object to the occurrence of a result against the data subject by analyzing the processed data exclusively through automated systems,
ğ) Request compensation for damages arising from unlawful processing of personal data.

Pursuant to Article 11 of the KVKK titled “Rights of the Data Subject”, you may submit your requests regarding your personal data in writing to Kocatepe, Topçu St. No:2, 34437 Beyoğlu / Istanbul, or via e-mail to kvkkpointtaksim@pointhotel.com.
Your requests will be concluded free of charge as soon as possible and no later than thirty (30) days, depending on the nature of the request. However, if the process requires an additional cost, a fee determined by the Personal Data Protection Board may be charged.

This Privacy Notice may be revised by the HOTEL when deemed necessary.
